AGREEMENT is made by and between
Royal Lead Boarding Kennel, LLC, 154 County Road 34 W, Jackson, MN 56143

FOR VALUABLE
CONSIDERATION, IT IS HEREBY AGREED by and between RLBK and Owner
that from time to time Owner may deliver to RLBK the following-identified pets
for boarding, grooming, or both, at rates posted in the RLBK kennel from time to time and on the following terms and conditions.

doesn’t know your pet as well as you do & can’t predict which pets may be

3. No Shots, No Docs, No Service! RLBK
will not board, provide daycare for, or groom Owner's Pet without current vaccination information. OWNER,

Pet
Drop Off & Pickup: RLBK strives
to be “Owner-Friendly” &, accordingly, allows Owners – at Owner’s risk – to
drop off & pick up their pets without RLBK staff present.
5.1. If Owner
prefers not to assume the risk, Owner may contact RLBK to arrange an
appointment for supervised drop off or pick up.
5.2. Owner hereby authorizes RLBK to release your
pet to the following-named person(s):
10. RLBK reserves the right to immediately change Owner's Pet’s type of boarding or daycare
if RLBK, in its sole discretion, determines that
it is necessary to protect the health and well-being of Owner's Pet, of other pets, or of RLBK staff; and Owner agrees to pay any additional costs
associated with the change.
11. Owner agrees [i] to pay all costs and charges for special services requested,
and [ii] to provide current
vaccination records for Owner’s Pet promptly on RLBK’s request.
12. Removal. Owner
agrees that Owner’s Pet shall not be removed from
RLBK’s premises until ALL CHARGES are paid in
full to RLBK.
12.1. RLBK
accepts payment by CHECK, CASH, & CREDIT CARD.
12.2. For
payment by CREDIT CARD, [i] information cards are available on
the counter in the kennel entry, & [ii]
RLBK will shred the information cards after processing payment.
12.3. Deposit
all payments in the lock box on the west wall near the counter in the kennel
entry.
13. Liability for damages. Owner
agrees to be solely responsible for any and all damages and injuries caused by
acts or behavior of Owner’s Pet while in or about RLBK's premises.
14. Title. Owner
specifically represents that Owner is the lawful and valid titleholder to Owner's Pet.
15. Rabies /
distemper. Owner specifically represents that Owner's Pet has not been exposed to rabies or distemper within 30
days prior to boarding.
16. Extended stays. If
for any reason
Owner's Pet is not going to be picked up as scheduled, then Owner
shall contact RLBK to make arrangements to extend the Pet's stay and will pay the additional charges according to RLBK's posted rates.
17. Abandonment. In the event that charges for Owner's Pet are not paid when due according to this agreement, RLBK may
exercise its lawful rights upon ten (10) days written notice by delivering such
notice via first-class mail to Owner’s address first set forth above.
17.1. A pet that is
unclaimed at RLBK for ten (10) days beyond its scheduled discharge date [i] may
be considered as abandoned, and [ii] becomes the property of
RLBK.
17.2. RLBK will attempt to contact Owner, if abandonment becomes an issue.
18. Emergency
treatment. If Owner’s Pet becomes ill, or if the state of Owner's Pet's health otherwise requires
attention, then RLBK, at its sole discretion, may engage the services of a
veterinarian or arrange for other requisite attention to the pet at a cost up
to and including $200.00 or $ ,
whichever is greater. If a veterinarian
determines that treatment, the cost of which exceeds the authorized amount, is
needed to save the pet’s life or quality of life, and RLBK cannot reach Owner
or the Emergency Contact, then [i] RLBK
may authorize the veterinarian to perform the emergency treatment, and [ii] Owner shall be responsible for all
veterinary costs provided to the pet.
19. Liability limited. It
is expressly agreed by Owner and RLBK that RLBK’s liability in no event shall
exceed the lesser of the current chattel value of a pet of the same sex and species or the sum of $200.00, whichever is less.
20. Indemnification. Owner agrees to release, indemnify, and hold harmless
RLBK from any and all manner of damages, claims, loss, liabilities, costs or
expenses, including reasonable attorney’s fees and related costs, arising out
of or related to RLBK’s services for Owner's Pet,
except such which may arise from the gross negligence or intentional and
willful misconduct of RLBK.
21. Governing law / venue. This Agreement shall be governed by and construed according to the laws of the State of Minnesota. RLBK and Owner hereby [i] consent to the exclusive personal jurisdiction of the state and
federal courts of the State of Minnesota, and [ii] agree to negotiate and mediate in good faith prior to either
party filing a law suit.
22. Force
Majeure. Neither Owner nor RLBK shall be responsible for failure or delay in
performing its duties under this Agreement, if such
failure or delay is due to tornadoes,
thunderstorms, fire, floods, drought, riot, war or other acts of nature.
23. Entire
Agreement. This agreement, with any attached addendums, constitutes the entire agreement between
the parties. All terms and conditions of this agreement shall be binding on the
heirs, agents and assigns of Owner and RLBK.
